California RRP Rule Enforcement

The Lead Renovation, Repair, and Painting (RRP) Rule, has been in effect since April 22, 2010. The Environmental Protection Agency and Housing and Urban Development (HUD) created this rule under a joint venture. The rule is heavily EPA oriented but there are some additional requirements if the project you are doing is federally funded or owned. Many states across the nation including California follow the federal rule. People following the rule should understand, however, not all of the states follow the federal rule. Some states have chosen to enforce the rule. This means if you work in another state outside CA, you should verify if it is a federal or state run program. If the state has adopted the rules, they may have added additional requirements to comply with.

The Environmental Protection Agency (EPA) is responsible for enforcing the Lead RRP Rule in California. You can visit the EPA website to read the rule and find out how it applies to you. Visiting the sight on a routine basis will help you stay current on any updates.

Complying with the California Lead Certification Requirements

Individuals and companies do work under the rule are required to get certified to perform work in the state of California. There are easy steps to follow for compliance with California  Lead Paint Certification Requirements.

Steps for Certification in California:

Individuals:

  1. Register and attend a Lead Renovator Training class and successfully successfully pass the required exam. The class is 8 hours long. It typically begins at 8 a.m. and runs until 4 p.m. but timing can fluctuate a bit. Make sure to check availability to find the time that meets your needs. The average cost for RRP Certification is around $250, but just like most other things, location and demand have an effect on this. The hands-on skills provided during these courses ensures that you understand the content so you’ll be able to immediately apply it to your own work projects.
  2. Get  your lead certificate in only 1 day and maintain a copy of it on your job site while you do work in these pre-1978 properties. Hard copy or an electronic version is acceptable. According to the rule, a certificate saved on smartphone or computer is considered on site if you can pull it up. Please note that you are required to renew your certificate prior to the expiration in order to stay certified in the lead paint industry.

Companies:

  1. All companies (also known as firms), including sole proprietorships, are required to submit a  EPA Firm Application to the Environmental Protection Agency. This is a two page application that basically acknowledges that your company understands  the requirements of the RRP Rule and you will use lead trained personnel to do the work. You will also be listed on the EPA’s web site as a Lead-Safe Certified Firm.
  2. Receive and maintain a copy of your company’s certificate provided by the EPA. It is recommended to keep a copy on hand as proof of certification when working on the job. It can take up to 90 days to get your certificate.

NOTE: please make sure you have both certificates before you begin your work. Both are required by the rule.

Each agency may have slightly different information from the others. Remember, you must follow the most stringent requirements that apply to your project.
